Terms of Service

1. Agreement to Terms

By accessing or using BuildX Software products ("CMS", "CamX", collectively the "Services"), you agree to be bound by these Terms of Service. If you are using the Services on behalf of a company, you represent that you have authority to bind that company to these terms.

2. Description of Services

BuildX Software provides cloud-based construction management and job site photo documentation tools, including but not limited to:

  • CamX — Photo documentation, checklists, reports, AI-powered features, team collaboration
  • CMS — Lead management, estimates, proposals, project management, invoicing, accounting

3. Accounts & Registration

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

Each organization account may have multiple users with different roles (Admin, Project Manager, Engineer, Foreman, Viewer). The account owner is responsible for managing user access and permissions.

4. Subscription & Payment

Free Trial. New accounts receive a 14-day free trial. A valid payment method is required to start the trial. You will not be charged until the trial period ends.

Billing. Subscriptions are billed monthly or annually based on your selected plan. Prices are per-user and may vary by plan tier. All fees are non-refundable except as required by law.

Plan Changes. You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated charges. Downgrades take effect at the end of the current billing period.

Cancellation. You may cancel your subscription at any time from your account settings. Access continues through the end of the current billing period. No partial refunds are provided.

Promo Codes. Promotional discounts are subject to their specific terms including duration, eligibility, and usage limits. Promo codes cannot be combined unless explicitly marked as stackable.

5. Your Data

Ownership. You retain all ownership rights to your data, including photos, documents, reports, and project information uploaded to the Services.

License. You grant BuildX Software a limited license to process, store, and display your data solely for the purpose of providing the Services to you.

Export. You may export your data at any time through the platform's export features (PDF reports, photo downloads, data exports).

Deletion. Upon account cancellation, your data will be retained for 30 days, after which it will be permanently deleted. You may request immediate deletion by contacting support.

6. AI Features

CamX includes AI-powered features ("CamAI") including photo descriptions, task suggestions, section summaries, photo search, auto-categorization, and template generation. These features use third-party AI providers (Anthropic Claude) to process your data.

AI-generated content is provided as suggestions and should be reviewed for accuracy. BuildX Software is not responsible for the accuracy or completeness of AI-generated content.

Your photos and text submitted to AI features may be processed by third-party AI services but are not used to train AI models.

7. Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose
  • Upload malicious content or attempt to compromise system security
  • Resell, sublicense, or redistribute the Services without authorization
  • Exceed reasonable usage limits or abuse API access
  • Interfere with or disrupt the Services or other users' access
  • Use automated tools to scrape, crawl, or extract data from the Services

8. Intellectual Property

The Services, including all software, design, branding, and documentation, are owned by BuildX Software and protected by intellectual property laws. Your subscription grants a limited, non-exclusive, non-transferable license to use the Services.

9. Third-Party Integrations

The Services may integrate with third-party services including Stripe (payments), Anthropic (AI), and others. Your use of these services is subject to their respective terms. BuildX Software is not responsible for third-party service availability or data handling.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BUILDX SOFTWARE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES.

Our total liability for any claim arising from the Services shall not exceed the amount you paid to us in the 12 months preceding the claim.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Photos and documents stored on the platform should not be considered your sole backup. You are responsible for maintaining independent backups of critical data.

12. Indemnification

You agree to indemnify and hold harmless BuildX Software from any claims, damages, or expenses arising from your use of the Services, your violation of these terms, or your violation of any third-party rights.

13. Changes to Terms

We may update these terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Services after changes constitutes acceptance.

14. Governing Law

These terms are governed by the laws of the State of California, United States. Any disputes shall be resolved in the courts of California.
